You've found your dream apartment with a developer. The project is beautiful, the salesperson is nice, and they explain that a lawyer takes care of everything. Except that this lawyer — the one you partially pay — doesn't work for you. He works for the developer.
This is an unknown reality, and it can be expensive.
The developer's lawyer: competent, but not on your side
In any transaction with a real estate developer in Israel, it's the developer who drafts the contract, and it's their lawyer who handles it. This professional has a specific role: protect the developer's interests and manage the condominium registration.
He doesn't negotiate for you. He doesn't check if the clauses are unfavorable to you. He doesn't advise you on your taxation.
The law limits the fees he can charge you to 0.5% of the price or 5,915 NIS (whichever is lower). What you pay only covers the administrative management of the registration — not your representation.
What you risk by signing alone
A developer contract is a long, technical document, drafted in the seller's interest. Without independent guidance, you may miss important details:
Some indexation clauses on construction costs that significantly increase the final price
A payment schedule poorly adapted to your financing
Some legal warranties insufficiently verified
Some charges or restrictions on the property that no one has pointed out to you
A building permit non-compliant or incomplete
These points don't jump out when reading, but a professional who defends your interests will see them immediately.
What independent guidance concretely changes
Even before signing, a lawyer who works for you will:
Verify the developer's real rights on the land in the land registry
Ensure that permits are valid and the project compliant
Identify potential debts or restrictions on the property
Assess the developer's financial strength
During contract negotiation, he will:
Draft an amendment appendix to rebalance the clauses in your favor
Rework the indexation mechanisms to limit price increases
Adapt the payment schedule to your real situation
And after signing :
Monitor work progress and deadlines
Prepare you for delivery (reception, defects, remedies)
Coordinate documents with your bank
Declare acquisition tax and optimize your tax situation (single housing, replacement housing...)
How much it costs, how much it pays
An independent lawyer's fees are free and variable according to cases. But in a transaction that often represents several million shekels, a few thousand shekels of guidance can save you much more — on the final price, on unforeseen costs, or on taxation.

Buying off-plan in Israel is an exciting process. With the right guidance, it's even more so — without unpleasant surprises.
